Child porn found after rape report

They’ve both already admitted, to some degree, to what they’ve done, according to officials.

Gail E. Smith, also known as Gail E. Rees, allegedly said she knew that making reportedly pornographic films with her 9-year-old daughter and a third, unidentified, female was wrong, according to police reports.

Her soon-to-be ex-husband, Russell J. Rees, 34, allegedly admitted sharing the same juvenile female pornographic pictures on the Internet and masturbating in front of her in 2003, when she was 5 years old, the reports read.

What Rees reportedly didn’t admit to are the other sexually explicit allegations – including rape – that the Clallam County Sheriff’s Office brought to the Clallam County Superior Court, where both have been charged.

"My investigation started with an interview with the girl, who had allegations of rape, which she reported having occurred in 2003," said Sgt. Lyman Moores.

"After the interview, I went to arrest Mr. Rees on an outstanding warrant and obtained a second warrant (for driving without insurance) to search his home based on the new evidence."

What Moores found, he said, were several compact discs that portrayed Smith, her daughter and a third female in sexually explicit acts.

Smith, 39, faces charges of sending or bringing pictures of minors engaged in sexually explicit conduct into the state, dealing in depictions of a minor engaged in sexually explicit conduct, incest, sexual exploitation of a minor with elements of a crime, and first-degree

child molestation.

Smith allegedly had been sending the videos to a man in Georgia. Moores said he didn’t know the extent of the pornographic video collection in Rees’ and Smith’s confiscated computers.

"We haven’t totally looked into the computers yet because we want a professional to comb through them bit by bit to find any evidence, be that video or additional clients," he said, indicating charges came from evidence taken from compact discs.

"We’ve made contact with the FBI and they are aware of our investigations and may take the lead in any investigation into the Georgia man."

Moores said he believed the videos were filmed in Smith’s home. She is separated from Rees and lives in a different house in Sequim.

Smith is being held on $10,000 bail. Her charges could result in a maximum penalty of life in prison and $50,000 in fines

if convicted.

Rape charge

The extent of Rees’ participation in the videos is unknown so far, other than his alleged possession of them, which is a crime.

Rees’ charges stem from a

2003 incident in which he reportedly violated the girl with his hand, made her watch pornographic DVDs, and had her touch him inappropriately.

She was 5 years old at the time and although they are not related through blood, the alleged actions resulted in a first-degree incest charge.

Rees also is charged with first-degree rape of a child and first-degree child molestation.

The rape and molestation charge carry a maximum sentence of life in prison with $50,000 in fines each.

Rees is being held on $100,000 bail and is due in court at 1:30 p.m. Friday.

Smith is due in court at 1 p.m. today, Wednesday.
